By requesting a quote, accepting a pro-forma invoice, or taking delivery of any machinery from KCS Plant Hire, the client agrees to the following standard terms and conditions of hire. We believe in clear rules and direct communication to ensure your site runs without delays.
1. Rates, Inclusions, and Exclusions
Operators: All quoted daily rates include a certified KCS operator, except where explicitly stated otherwise on the specific equipment listing (e.g., small plant, chippers, and certain tractors).
Exclusions: Unless specifically quoted, all daily rates strictly exclude diesel, delivery charges, and staff accommodation for our operators.
Consumables: Fuel, 2-stroke oil, chainsaw blades, drill bits, and other wear-and-tear consumables are for the client’s account unless selected as a specific add-on during the booking process.
Pro-Forma Basis: Website requests are quote requests only. A booking is only confirmed once a Pro-Forma Invoice is generated by our operations team and payment terms are met.
2. Payment Terms
Cash Hire: For clients without an approved corporate account, full payment via EFT is required upfront before any equipment is dispatched from our yard.
Account Holders: Approved corporate clients operate on strictly 30-day terms from the date of invoice.
Minimum Hire: Certain heavy earthmoving equipment may be subject to minimum hire periods, which will be stipulated on your final quote.
3. Delivery and Site Access
Transport is quoted separately based on the distance to your site and the size of the rollback or flatdeck truck required.
The client is responsible for ensuring safe, clear, and legal access for our transport trucks to offload and load the equipment.
Time lost due to inaccessible sites, locked gates, or unprepared terrain remains billable to the client.
4. Breakdowns, Accountability, and Maintenance
Our Accountability: We ensure all equipment arrives on site fully serviced, compliant, and operational. If a machine suffers a mechanical breakdown due to normal wear and tear, we will repair or replace it as swiftly as possible.
Client Accountability: Breakdowns, tyre punctures, or structural damage caused by negligence, operator abuse (if self-operated), or using the machine outside of its intended capacity are strictly for the client’s account.
Escalation: Do not wait if there is an issue. Call operations immediately so we can fix it.
5. Risk, Liability, and Insurance
From the moment the equipment is offloaded on your site until it is collected by our transport team, the client bears the full risk of loss, theft, or malicious damage.
Clients are advised to ensure they have adequate Contractors All Risk (CAR) insurance or short-term plant hire insurance to cover the value of the machinery while in their care.
KCS Plant Hire shall not be held liable for any indirect, consequential, or project delay damages resulting from equipment downtime.
